In Nigeria, 40-year-old Man Rapes A 6-year-old Girl and Was Set Free By Court.

Abuja – An FCT  High Court on Monday discharged and acquitted 40-year-old, Sunday Ogbonna, of Jabi, Abuja, accused of allegedly raping a six-year-old girl.

Ogbonna was arraigned on Feb. 13, 2006, accused of rape, which contravened Section 283 of the Penal
Code. He was alleged to have lured the girl to a secret place at the Jabi Motor Park on Nov. 31, 2005 and forcibly had carnal knowledge of  her.

Delivering judgment, Justice Abubakar Talba said there was no consistency in the evidence of the witnesses produced by the prosecution.
Talba said further that the three prosecution witnesses contradicted themselves and could not be relied on, adding that the prosecution had failed to establish a case against the accused.
He added that there was no medical eveidence tendered in the case.
“Consequent upon the above findings, I hereby discharge and acquit the accused,” he said. (NAN)

Why won't the prosecution lacks competence? when policemen are the only ones that can prosecute criminal cases..so sad.
